GENERAL
Please read carefully, as this pertains to the Agreement of your registration with any of the offers sold on this webpage (sometimes referred to as event, activity, session or treatment) by Elisabetta Mancini (“I”, “we”, "Elys", "Coach", "me" or “us”), who owns and operate this website (the “Site”). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Notice and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Elys. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
We reserve the right to change these Terms of Service or to impose new conditions on the use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.
RESOURCES
Elys agrees to provide coaching services and holistic treatments and support to help Clients in their complete well-being journey. The client agrees to abide by all policies and procedures outlined in this Agreement as a condition of their participation in any of the offers/resources.
Elys retains all copyright licence rights and sole exclusive ownership of the information, photographs and material displayed on its website. The material may not be modified, copied or used in any other way.
DISCLAIMER
The client understands Elys is not a doctor, a medical professional, a registered therapist, or a trained clinician of any kind that solves or treats clinical problems, nor does she make any claims of being able to do so. Elys doesn’t “prescribe” anything regarding wellness practices or otherwise, her opinions and suggestions are merely ideas to consider.
The client understands their participation in this program will not treat or diagnose any disease, illness, or ailment and if they should experience any such issues they should see their registered physician or other practitioners as determined by their own judgment.
Elys works on mindset and personal development: training the habit of making healthy personal choices from a mental, physical and spiritual perspective through behavioural transformation and personal development.
Individuals with serious health conditions should seek outside medical or psychological support if consider working with Elys or purchasing her products.
If the Client is struggling with a disorder beyond the scope of coaching, please consult a health professional before basing any health decisions on the information presented on this site or suggested; before following any of the Coach’s advice or recommendations; or before beginning any training or coaching program.
Elys' goal is to empower her clients by sharing her own approach, her own system and experience based on Life Coaching, NLP techniques, intuition, Reiki spiritual and energetic practices.
The Client’s voluntary participation in these activities specifically absolves Elys of any and all liability related to the information provided here. The Clients acknowledge that has completely read and fully understands the above release and agrees to be bound thereby.
CLIENT RESPONSIBILITY
It is the Client’s responsibility to check the bookings and ensure that the particulars contained therein are correct.
Any user of the website has to be 18 years of age or older and agrees to be entirely financially responsible for all charges and other fees arising from the bookings and use of the website.
The Client must comply fully with all and any health and safety regulations. The Client must ensure that they are medically and physically fit and able to use the facilities and participate in activities. Clients who have injuries or illnesses are advised to seek a doctor’s advice. Elys is not liable for any injuries to the Client in their use of the facilities or participation in activities. The Client must always stop and rest if they are feeling any pain or sickness and inform Elys of any previous injuries.
The Client shall not use the event, session or activity property except for permitted use and shall not use the property for any offensive, noisy, dangerous, illegal, or improper purposes. The Client shall not do anything which may be a nuisance or annoyance to Elys and the property guests, staff or owners.
The Client shall keep all fixtures, fittings, furniture and effects on the property, where the event, session or activity is held, in a clean and good condition and shall pay damages to the property owner for any articles which are destroyed or missing. Elys shall under no circumstances be liable for any damage to the property caused by the Client.
Elys reserves the right at its sole discretion to terminate the use of the property or any of its facilities by the Client in the event, session or activity of any breach of these terms and conditions. The Client will be required to vacate the property and Elys shall not refund payment or accept any consequential liability damages or loss.
Elys cannot accept any responsibility for the loss or damage of personal possessions or valuables of the Client.
Elys accepts no liability for loss, damage, injury or illnesses which may be received during the Client's stay or travelling to and from the property that hosts the event, session or activity.
PAYMENT AND DISCOUNT
The Client may pay up-front or in person in full. The total amount due for each person named in the reservation is non-refundable but transferable.
Elys reserves the right to offer discretionary discounts and this does not affect the status of any guests who have paid the full price and no discount will then become due to them.
FORCE MAJEURE
Elys shall not be liable for any failures beyond its control. This covers natural disasters, war, ‘acts of God’, closure of airports, cancellation of flights, civil strife, pandemics and regional epidemics, accidents or failure to perform by third parties. Should ‘Force Majeure’ impede or prevent Elys from hosting an event, session or activity or should the client decide to cancel based on ‘Force Majeure’ there is a zero refund policy.
The same conditions apply if the Client tests positive for COVID-19 before the date of the activity purchased.
Due to situations beyond our control (Force Majeure) Elys reserves the right to change bookings, postpone, or cancel the event, session or activity and shall inform the Client as soon as possible. Elys does not accept responsibility for any costs incurred due to cancellation or postponement. Credit will be offered in the form of vouchers for all Elys’ products for a later date of the same event, session or activity or another event, session or activity hosted by Elys of the Client’s choice. Vouchers can be redeemed for Elys products only.
RESOLUTION OF DISPUTES
If not resolved first by good-faith negotiation between the Parties, every controversy or dispute relating to this Agreement will be submitted to the Portuguese Arbitration Association. All claims against the Coach must be lodged within 100-days of the date of the first claim or otherwise be forfeited forever. The arbitration shall occur within ninety (90) days from the date of the initial arbitration demand. The Parties shall cooperate to ensure that the arbitration process is completed within the ninety (90) day period. The Parties shall cooperate in exchanging and expediting discovery as part of the arbitration process. The written decision of the arbitrators (which will provide for the payment of costs) will be absolutely binding and conclusive and not subject to judicial review and may be entered and enforced in any court of proper jurisdiction, either as a judgment of law or a decree in equity, as circumstances may indicate. In disputes involving unpaid balances on behalf of the Client, the Client is responsible for any and all arbitration and attorney fees.
Other
Elys does not warrant or make any representations regarding the use or the results of the use of the site or materials on this site or on third-party sites in terms of their correctness, accuracy, timeliness, reliability or otherwise.
If you believe in good faith that materials hosted by Elys infringe your copyright, you, or your agent may send to her a notice at [email protected] requesting that the material be removed or access to it be blocked. Any notification by a copyright owner or a person authorized to act on its behalf that fails to comply with legal requirements shall not be considered sufficient notice and shall not be deemed to confer upon Elys actual knowledge of facts or circumstances from which infringing material or acts are evident. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, you shall send to Elys a counter-notice.
This Agreement shall be binding upon and inure to the benefit of Elys and our respective assigns, successors, heirs, and legal representatives. Neither this Agreement nor any rights hereunder may be assigned without the prior written consent of Elys. Notwithstanding the foregoing, all rights and obligations under this Agreement may be freely assigned by Elys to any affiliated entity or any of its wholly owned subsidiaries.
These Terms of Use shall be governed by and construed in accordance with the laws of Portugal and any dispute shall be subject to binding arbitration in Olhão, Portugal. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
CHANGES
The terms and conditions form a binding agreement between the Client and Elys. Elys reserves the right, in its sole discretion, to change the terms and conditions without advance notice. The most current version of the terms and conditions will supersede all previous versions. Elys encourages the Client to periodically review the terms and conditions to stay informed of updates.
Elys accepts no responsibility for keeping the website up to date and will not be liable for any loss by its failure to do so. We are not responsible for the contents of any links displayed on our website.
Although it is highly unlikely, This policy may be changed at any time at our discretion. If we should update this policy, we will post the updates to this page on our Website.
